General Terms and Conditions (GTC)

1) Scope of Application

For all business relationships between ELYSIA - Jewelry Atelier and you, exclusively these General Terms and Conditions (GTC) in the version valid at the time of contract conclusion apply. ELYSIA - Jewelry Atelier generally does not recognize any differing terms unless expressly agreed in writing by the owner. By placing an order, you agree to these GTC, which thereby become part of the individual purchase contract. Changes to our General Terms and Conditions become effective upon their publication on the website.

2) Conclusion of Contract

When you place an order in our online shop, this constitutes a binding offer to conclude a contract with us. After placing your order, we will send you an email confirming receipt of your order, which also serves as the invoice for your purchase. This order confirmation contains all details of your order (including ordered products, prices, delivery, and payment terms). Upon receipt of this confirmation, ELYSIA - Jewelry Atelier accepts your order, thereby concluding the purchase contract.

However, we reserve the right to revoke the acceptance of the purchase contract within 24 hours after sending the confirmation email. This may occur, for example, if the ordered goods exceed a reasonable household quantity or are not deliverable. In the legally compliant conclusion of a purchase contract, the customer is liable for correct data transmission. According to standard business practice, ELYSIA - Jewelry Atelier assumes that any data about third parties you provide (e.g., for gift delivery) is accurate, and that the third party will be informed by you about the data transmission for contract fulfillment at the latest upon first contact with the customer (e.g., delivery of the gift). The contract language is German.

3) Right of Withdrawal

3.1 Right of Withdrawal for Austrian Consumers

3.1.1 Right of Cancellation

You may withdraw from your purchase contract within 14 days without giving any reason. The withdrawal period begins upon receipt of this instruction in text form but not before the goods arrive with you. The day the period starts (contract conclusion or receipt by the customer) is not included. Withdrawal must be requested in writing via email to elysiaatelier.office@gmail.com within the withdrawal period. Further information about returns will be provided by email.

3.1.2 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the following cases:

• Items marked as “Sale” or offered at reduced prices

• Goods manufactured according to customer specifications and clearly tailored to personal needs (e.g., all rings, personalized necklaces, special lengths, or custom-made components)

• Goods unsuitable for return due to their nature

The goods must be returned properly packaged. The customer is liable for lost goods due to inadequate packaging or sealing. We recommend registered or insured shipping as the customer is liable for loss by the shipping provider. If the customer is a business entity according to § 1 UGB, withdrawal is completely excluded.

3.2 Consequences of Withdrawal and Compensation for Deterioration

In the case of a valid withdrawal, both parties must return received benefits and possibly hand over derived benefits. If you cannot return the goods completely, partially, or only in a deteriorated condition (e.g., with signs of use, damage, or dirt), you must compensate for the reduced value. However, deterioration solely due to a short inspection of the goods is not a reason for compensation. Return shipping costs are borne by the customer. ELYSIA - Jewelry Atelier does not provide return labels. Returns must be shipped at your own cost and risk. It is recommended to ship insured and keep the tracking number, which must be provided upon request. ELYSIA - Jewelry Atelier does not accept packages sent freight collect or those requiring customs duties, VAT, or other charges.

If there is a claim for reimbursement of return shipping costs, the corresponding postal receipt must be submitted within 7 days after shipping the return by email or post. After this period, the claim expires. The date on the postal receipt is decisive. Refunds for fully undamaged and unused goods will be made within 14 days starting from receipt of the goods. Until the goods arrive, we reserve the right to withhold the refund.

3.3 Right of Withdrawal for German and other EU Consumers (excluding Austria)

3.3.1 Right of Withdrawal

You may withdraw from your purchase contract with ELYSIA - Jewelry Atelier within 14 days without giving reasons. The period starts upon receipt of this instruction in text form but not before the goods arrive with you and before we have fulfilled our information obligations under Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB as well as our duties under § 312e paragraph 1 sentence 1 BGB in conjunction with § 246 § 3 EGBGB. The day the period starts is not included. Withdrawal must be requested in writing via email to elysiaatelier.office@gmail.com within the withdrawal period. Further information about returns will be provided by email.

3.3.2 Consequences of Withdrawal

If you cannot return the goods completely, partially, or only in deteriorated condition (e.g., with signs of use, damage, or dirt), you must compensate for the reduced value. Deterioration due solely to brief inspection is not grounds for compensation. Return shipping costs are borne by the customer. ELYSIA - Jewelry Atelier does not provide return labels. Returns must be shipped at your own cost and risk. It is recommended to ship insured and keep the tracking number, which must be provided on request. ELYSIA - Jewelry Atelier does not accept freight collect packages or those requiring customs duties, VAT, or other charges.

Refunds for fully undamaged and unused goods will be made within 14 days starting from receipt of the goods. Until goods arrive, we reserve the right to withhold the refund.

3.4 Warranty (Liability for Defects)

3.4.1

The statutory warranty period of two years from delivery of the goods applies.

3.4.2

Obvious defects must be reported to us in writing within 7 days of receipt at elysiaatelier.office@gmail.com. Missing this deadline does not affect your statutory warranty rights but helps with faster processing.

In case of a justified defect, you have the right to repair or replacement. If repair or replacement fails or is impossible, you may rescind the purchase contract.

If there is a claim for reimbursement of return shipping costs, the postal receipt must be submitted within 7 days after sending the return by email or post. After this period, the claim expires. The postal receipt date is decisive.

3.4.3

Minor deviations in shape, color, texture, or size due to the handcrafted nature of our jewelry are not defects and not grounds for complaint. We do not assume liability for damages or defects caused after delivery (e.g., improper handling).

3.4.4

Warranty is excluded for defects or damages caused by:

• Improper or unintended use

• Faulty or negligent handling

• Use of unsuitable accessories

• Unauthorized alterations or interventions by the customer or third parties

• Force majeure (e.g., fire, water, lightning)

• Natural wear and tear due to excessive use

3.4.5

If a voluntary guarantee is granted, its conditions apply separately. The guarantee also expires if the product is improperly handled or unauthorized interventions occur.

4) Prices

All prices on our website are in euros and exclusive of VAT, as we operate as a small business under § 6 para. 1 item 27 UStG and therefore do not charge VAT. Prices are plus shipping costs at the time of order. Any export or import duties (e.g., customs) are the customer’s responsibility.

We reserve the right to charge reminder fees in case of payment default.

5) Payment Terms

5.1 Payment Methods

You may choose between the following methods:

• Credit Card (Visa, Mastercard, Diners Club, American Express)
  Credit card data entered in the order form is transmitted securely via SSL encryption, protecting against unauthorized access.

• PayPal
  PayPal allows fast, simple, and secure payments via an online account without repeatedly entering card or bank details.

• SOFORT Banking
  A quick and easy bank transfer method via online banking.

• Purchase on Invoice (Klarna)

• Google Pay and Apple Pay
  Mobile payment solutions linked to your credit card or bank account via Google or Apple accounts.

Refunds by the seller are credited via the original payment method.

6) Delivery / Shipping Costs

We deliver to all EU countries. Delivery to other countries is not available. Exceptions may occur due to temporary restrictions by carriers like Österreichische Post, DPD Austria, or GLS. Delivery is to the address you provide unless otherwise agreed. Delivery times and availability are estimates and not guaranteed. If goods are unavailable, we reserve the right to withdraw from the contract and notify you immediately. Additional shipping costs may be charged for failed delivery attempts or refusal of acceptance. Return shipping costs are not reimbursed by ELYSIA - Jewelry Atelier.

7) Retention of Title

The delivered goods remain the property of ELYSIA - Jewelry Atelier until full payment of the price and any shipping costs. The contracting party waives the right to offsetting. For consumers, this does not apply to counterclaims related to our claim, judicially established or expressly recognized by us.

All elements (images, texts, etc.) of www.elysia-atelier.com and associated social media pages (https://www.instagram.com/elysia.at/) are intellectual property of ELYSIA - Jewelry Atelier. Linking to our homepage is permitted. Use of images with source credit (www.elysia-atelier.com) and author mention (ELYSIA - Jewelry Atelier) is allowed. Copying or reproducing parts of the site for other purposes (e.g., copying product texts or FAQ passages) is strictly prohibited without written consent.

9) Consent and Revocation for Receiving Marketing Emails

You agree to receive messages from our company about products, offers, and company information via marketing emails,

In the event that individual provisions of these General Terms and Conditions (GTC) are or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
